After Winning Legal Requirement

The Two-Year Home
Residency Requirement

Section 212(e) of the Immigration and Nationality Act requires Fulbright scholars to return home for two years after their program. It's not optional, it's not easy to waive, and many applicants don't fully understand it until it's too late.

The Two-Year Home Residency Rule

After your J-1 visa expires, you must return to your home country for at least two years before applying for H-1B work visas, L-1 visas, or immigrant visas (green cards). This is legally binding.

Non-negotiable: Waivers are "extremely rare" for Fulbright scholars. Some governments refuse to issue "no objection" statements. Know this before you apply.

Does the Two-Year Rule Apply to You?

Will you be on a J-1 visa funded by the U.S. government (Fulbright)?

Is your home government on the "skills list" or does it require your return?

The two-year rule likely does not apply to you. But verify with an immigration attorney if unsure.
